Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Pratyush Saxena, an individual sole proprietor doing business as "Drizzle" ("Drizzle," "we," "us," or "our"), governing your use of the Drizzle mobile application and the website at https://joindrizzle.com (together, the "Service").

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Service.

1. Who can use Drizzle

You must be at least 18 years old to use the Service. By using Drizzle, you represent that you are 18 or older and that the information you provide is accurate. You are responsible for keeping your account credentials secure and for all activity under your account.

2. Drizzle is not medical advice

Drizzle is a peer-support community, not a healthcare provider. Content on Drizzle — including posts, comments, messages, and community information — is shared by other users and is not medical advice. It is not a substitute for professional diagnosis, treatment, or the advice of a qualified healthcare provider. Never disregard or delay seeking professional medical advice because of something you read on Drizzle. In an emergency, call your local emergency number. See our Medical Disclaimer. Drizzle is independent and not affiliated with any medical organization.

3. Your content

  • You own your content. You retain ownership of the posts, comments, messages, photos, and other content you create ("Your Content").
  • License to operate the Service. You grant Drizzle a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate and provide the Service to you and to the audiences you choose. This license ends when you delete Your Content or your account, except for content others have already saved or for residual backup copies as described in the Privacy Policy.
  • Responsibility. You are solely responsible for Your Content and for ensuring you have the right to share it. Do not post personal information of others without their consent.

4. Acceptable use

You agree to follow our Community Guidelines. You will not:

  • harass, threaten, bully, or harm other users;
  • post hateful, discriminatory, or violent content;
  • post content that promotes or encourages self-harm, eating disorders, or suicide (sharing your own struggles for support is welcome; encouraging harm is not);
  • post medical misinformation that could endanger others, or impersonate a medical professional;
  • spam, advertise, sell products or services, or solicit users;
  • impersonate any person or misrepresent your affiliation;
  • attempt to access accounts or data that are not yours, probe or breach security, or circumvent rate limits or access controls;
  • scrape, harvest, or collect other users' data;
  • upload malware or interfere with the Service's operation;
  • use the Service for any unlawful purpose.

5. Safety, moderation, and enforcement

We may review, remove, or restrict content and may suspend or terminate accounts that violate these Terms or our Community Guidelines, or to protect the safety of the community. We provide tools to block and report other users; reports are reviewed by our moderation team. We may act on reports at our discretion. We are not obligated to monitor all content but may do so.

6. Account suspension and termination

You may delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Upon termination, your right to use the Service ends; sections of these Terms that by their nature should survive (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

7. Third-party services

The Service relies on third-party providers (listed in our Privacy Policy) and may link to third-party resources. We are not responsible for third-party content or services, and your use of them may be subject to their own terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT (INCLUDING HEALTH-RELATED CONTENT FROM OTHER USERS) IS ACCURATE OR RELIABLE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIZZLE AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (WHICH FOR A FREE SERVICE IS USUALLY ZERO) OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Drizzle and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

11. Changes to the Service and these Terms

We may modify or discontinue features of the Service at any time. We may update these Terms; if we make material changes we will notify you through the Service or by email before they take effect. Your continued use after changes take effect constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the State of Virginia, USA, without regard to its conflict-of-laws rules. You agree that the courts located in the State of Virginia, USA will have exclusive jurisdiction, except where applicable consumer-protection law gives you the right to bring claims in your home jurisdiction. Nothing in these Terms limits any mandatory statutory rights you have as a consumer.
